Terms and Conditions

These Terms and Conditions ("Terms") cover your use of the forgiahq.com website, the Forgia waitlist and the free Trading Rules Checklist. They do not cover the Forgia app, which is not available yet.

Acceptance of these Terms

By using the website, joining the waitlist or downloading the checklist, you agree to these Terms. If you do not agree, please do not use them.

Who we are

Forgia is a Trading Reflection Platform in development. Forgia is operated by a sole proprietor based in India ("Forgia", "we", "us"). You can contact us at hello@forgiahq.com.

Eligibility

You must be 18 or over to use the website, join the waitlist or download the checklist. By using them, you confirm that you are 18 or over.

The waitlist

• Joining the waitlist is free and does not create any obligation for you to buy anything.
• Joining the waitlist does not guarantee access to Forgia, a place in any early access group, or any particular feature, price or offer.
• We have not announced a launch date, and we do not promise that Forgia will launch by any particular time, or at all.
• We may change, pause or close the waitlist, or change our plans for Forgia, at any time.
• You can leave the waitlist at any time by using the unsubscribe link in our emails or by emailing hello@forgiahq.com.

The free Trading Rules Checklist

We own the Trading Rules Checklist. We give you a personal, non-exclusive, non-transferable, revocable licence to download, print and use it for your own non-commercial use.

You may not:

• sell, resell, rent or license the checklist or any part of it;
• share, publish or distribute it, for example by posting it online or including it in a product, course or paid community;
• remove our name, logo or notices from it, or present it as your own work.

The checklist is general educational material about trading discipline. It is not financial advice, and using it does not guarantee any trading results.

Intellectual property and the Forgia name

The website, the checklist, and all text, designs, graphics, logos and software on them belong to Forgia or our licensors. "Forgia", "Forgia HQ" and our logos are our brand names and identifiers. You may not use them in any way that suggests a connection with us, or that we endorse you, without our written permission. Nothing in these Terms gives you any ownership of our intellectual property.

Acceptable use

You agree not to:

• use the website in any way that breaks the law or these Terms;
• join the waitlist with someone else's email address, or with false or automated sign-ups;
• try to gain unauthorised access to the website, its systems or its data, or interfere with how it works;
• scrape, copy or harvest content or data from the website using automated means, except as allowed by normal search engine indexing;
• upload or send viruses, malware or harmful code;
• use the website to send spam or to impersonate us or anyone else.

Not financial advice

Forgia is a Trading Reflection Platform: a tool to help you record and reflect on your own trading decisions.

• Forgia is not a broker. It does not hold your money, place trades or connect to your trading account.
• Forgia does not provide trading signals, recommendations, or financial, investment, tax or legal advice.
• Nothing on the website, in the checklist or in our emails is an offer, solicitation or recommendation to buy or sell any financial instrument.
• Trading Forex, gold, crypto, stocks, options, futures, CFDs and other instruments involves substantial risk of loss. Leveraged products can lose you more than you deposit.
• Forgia does not guarantee any trading results, profits or improvement in performance. Past performance is not a guide to future results.

Your responsibility

You are solely responsible for your trading decisions and their outcomes, and for deciding whether any trading activity is suitable for you. If you need advice, speak to a qualified, regulated professional.

Third-party links and services

The website and our emails may link to websites or services run by other people. We do not control them and are not responsible for their content, policies or practices. Using them is at your own risk and under their own terms.

Disclaimer of warranties

The website, the waitlist and the checklist are provided free of charge, "as is" and "as available". To the extent the law allows, we make no promises or warranties of any kind, whether express or implied, including that they will be accurate, complete, uninterrupted, error-free or fit for a particular purpose.

Limitation of liability

To the extent the law allows, Forgia will not be liable for:

• any trading losses, or any loss of profits, revenue, data, opportunity or goodwill;
• any indirect, incidental, special or consequential loss;

arising from your use of, or inability to use, the website, the waitlist or the checklist. Because these are provided free of charge, our total liability to you for any claim relating to them is limited to USD 100.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. This includes liability for death or personal injury caused by negligence, liability for fraud or fraudulent misrepresentation, and your rights as a consumer under the laws of the country where you live, including UK and EU consumer rights.

Indemnity

If you break these Terms or the law when using the website or the checklist, and that causes us a loss or a claim from someone else, you agree to cover the reasonable costs that result. This does not apply to the extent that the loss was caused by us.

Privacy

Our Privacy Policy explains how we handle your personal data. You can read it at /privacy.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date, and we will email waitlist members about important changes. If you keep using the website after a change, the updated Terms apply.

Ending your use

You can stop using the website and leave the waitlist at any time. We may suspend or remove your access to the website or the waitlist, or remove you from the waitlist, if you break these Terms or if we stop running the waitlist. The sections on intellectual property, not financial advice, disclaimers, limitation of liability, indemnity and governing law continue to apply after that.

Future paid plans

The Forgia app and paid plans are not available yet. Before paid plans open, we will publish separate terms covering subscriptions, pricing, free trials, refunds, cancellations and our partner program. Those terms will govern any purchase or partner relationship, and they will take priority over these Terms where they apply.

Governing law

These Terms are governed by the laws of India. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live.

General

If any part of these Terms is found to be unenforceable, the rest stays in effect. If we don't enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms. We may transfer ours, for example to a company we form to run Forgia, as long as this does not reduce your rights.
